Asociația POT SĂ AJUT ("the Association") processes personal data in a confidential, secure, and transparent manner, and ensures that you can continue to trust how we handle the data you provide to us.
Asociația POT SĂ AJUT manages the website www.potsaajut.ro together with all the programs available on this platform, and this Privacy Policy covers all activities undertaken for the purpose of running the programs supported and managed by the Association.
Our website does not collect any personal information about its visitors or how they use it.
We do not store any cookies on your device, we do not collect IP addresses, and we do not use intrusive techniques such as unique identifiers or browser fingerprinting to identify you.
1. Terms used
a. Privacy Policy – the information contained in this document, which sets out the ways your personal data is collected, processed, and shared ("the Policy")
b. Programs – all programs/projects supported and managed by Asociația POT SĂ AJUT, such as Biblioteca cu Speranță, Împreună în Timp, O zi altfel, and others, together with the website www.potsaajut.ro\
c. Partners – associations, foundations, non-profit organizations, schools, trainers, as well as any other third parties and their representatives, alongside whom the Association carries out its activity
d. Visitors – individuals who access www.potsaajut.ro without having an account
e. Beneficiaries – individuals who benefit from the Association's Programs
f. Donors – individuals or legal entities who support the Association's Programs through donations / sponsorships / bequests / patronage
g. Volunteers – individuals who support the Association's Programs through volunteer activity
h. Candidates – individuals who apply for a job within the Association.
2. Who is the personal data controller?
Asociația POT SĂ AJUT is the controller of personal data. The Association is a Romanian non-profit organization registered with the Register of Associations, Foundations and Federations under no. 15/09.05.2016, having C.I.F. 36091050.
The Association is registered in the Register of religious entities/units eligible for tax deductions under no. 6530042/03.10.2019 and is accredited as a social services provider by the Ministry of Labour and Social Justice under series AF no. 006123.
Please note that when you benefit from the Association's Programs through our Partners, your data is collected directly by them, the Partners also being controllers of personal data.
For any question regarding your personal data or to exercise your legal rights, you may contact us at office@potsaajut.ro.
You may also send any requests regarding personal data by post to Str. Coralului Nr.3 Bl.2 Et.4 Ap.28, Bragadiru, Ilfov, România, postal code 077025.
We will respond to your requests within the legal deadline. However, please note that in certain situations, for technical reasons, implementing your requests or choices may take a few days, during which Asociația POT SĂ AJUT will continue to process your personal data based on the choices previously expressed.
Please also note that this Privacy Policy applies to situations where the Association is the controller of personal data, namely when it, independently or together with its Partners, determines the purpose and manner of processing. In this case, the data may be provided by you directly or through the Partners.
3. What personal data we process and how we obtain it
In order to manage the Association's Programs, we process personal data (referred to for short as personal data). This is information that identifies you directly or by which you can be identified. Certain data is collected directly from you, while other data is collected passively by the Association, for example from public sources or from our Partners.
To this end, the Association processes the following types of personal data:
Identification data such as: first name, last name, date of birth, citizenship, image, series and number of an identification document that formally attests to your identity
Contact data such as: home mailing address, correspondence address, e-mail, phone number
Qualification data such as: position held, documents attesting to profession or occupation, mandate to represent the legal entity, level of education, CV
Data regarding interaction with the Programs and the Association such as: frequency of use, level of satisfaction, opinions, communications
Data voluntarily entered into the platform such as: subjects studied, materials studied or uploaded, grades, descriptions, comments
Data of minors: given the Programs it supports and manages, Asociația POT SĂ AJUT processes data of minors. However, the Association, either directly or through its Partners, ensures that the holder of parental responsibility is informed of and consents to this processing.
Where your capacity is that of User, but access to the Association's Programs occurs following the entry of your data into one of the Programs by the Partner, the Partner is responsible for all data provided as well as for the choices expressed by the User. Also, in this case, the Partner is responsible for informing and obtaining the consent of the holder of parental responsibility regarding the processing of minors' data.
Where your capacity is that of Beneficiary, Asociația POT SĂ AJUT processes your personal data only where the data is transmitted by the Partner and the Partner assures the Association that your rights have been and continue to be respected, in particular the right to information. In this regard, where processing is based on your consent, informing you and obtaining that consent is done by the Partner, directly from you or from the holder of parental responsibility regarding the processing of minors' data.
When you contact us using the form on the Contact page, the information you enter will be processed and stored by an external partner, Basin, which will send us an e-mail containing this information.
Specifically, Basin will store the following data:
- Your first and last name
- Your e-mail address
- Your phone number
- The message you wrote
- Your consent regarding the processing of data

4. Purposes and legal bases for processing personal data
4.1. Where your capacity is that of Beneficiary, User, Donor, Volunteer, or Partner, Asociația POT SĂ AJUT processes your personal data for the following purposes:
a. Selecting the Donors, Volunteers, and Partners alongside whom it carries out its activity, carrying out eligibility checks regarding them, as well as receiving and managing sponsorships received – for this purpose the Association processes personal data in order to choose the individuals and/or organizations, to administer the necessary forms, to meet the related legal obligations, and to manage the sums and/or goods received.
This purpose may be based on the following legal grounds:
- Entering into and performing a contract with you;
- The Association's compliance with specific legal obligations;
- The Association's Legitimate Interest in verifying that the criteria and standards necessary to be involved in the Programs carried out are met, or to receive sponsorships in order to bring the Association's purpose, through the Programs it supports, to a successful conclusion.
b. Selecting and implementing the Programs it supports and manages together with its Partners – depending on the type of Program and your role, Asociația POT SĂ AJUT processes your personal data in order to select the Programs it will support, to provide support throughout them, and to bring their implementation to a successful conclusion, and may also make a limited set of personal data available to Partners, as necessary for implementing the Programs.
This purpose may be based on the following legal grounds:
- Entering into and performing a contract with you;
- The Association's compliance with specific legal obligations;
- The Association's Legitimate Interest in implementing and successfully completing the Programs it supports;
- Your consent to be contacted regarding the Association's activity and your involvement in the Programs supported by the Association.
c. Implementing and managing the Programs the Association supports independently – depending on the type of program and your role, Asociația POT SĂ AJUT processes your personal data in order to give you access to the Programs supported, to the related materials and digital resources, and to provide you with support throughout the Programs.
This purpose may be based on the following legal grounds:
- Entering into and performing a contract with you;
- The Association's compliance with specific legal obligations;
- The Association's Legitimate Interest in implementing and successfully completing the Programs it supports;
- Your consent to be contacted regarding the Association's activity and your involvement in the Programs supported by the Association.
d. Promoting the Projects supported and managed by the Association, as well as the events organized by the Association, through promotional materials in various media – depending on the type of program and your role, Asociația POT SĂ AJUT may process your personal data in order to request feedback about your experience or to evaluate the effectiveness of the Programs carried out, to create promotional materials, and to publish them online or physically in order to promote the Programs and the Partners.
This purpose may be based on the following legal grounds:
- Your consent, expressed directly to Asociația POT SĂ AJUT or to the Partner, for the processing of your identification data, such as first name, last name, and image
e. Managing the Association's online presence – for this purpose the Association processes personal data in order to administer its accounts on various online networks. Please note that in this case the privacy policy of those service providers applies primarily, and the Association processes a limited set of data where you choose to interact with the Association's online accounts.
This purpose may be based on the following legal grounds:
- Your consent, expressed directly to Asociația POT SĂ AJUT or to the service provider;
- The Association's Legitimate Interest in having an online presence on various networks relevant to the Association's activity and in managing its activity with data subjects who choose to interact with the Association through these networks.
f. Preparing management and statistical reports – in this case Asociația POT SĂ AJUT processes your data in a manner that does not individually identify you, and may subsequently turn this data into anonymous data in order to analyze the Programs carried out.
This purpose may be based on the following legal grounds:
- The Association's compliance with specific legal obligations;
- Asociația POT SĂ AJUT's Legitimate Interest in analyzing the Programs it supports and reporting to Partners.
g. Compliance with specific legal and regulatory requirements, contained in both national and European legislation, as well as fraud detection and the resolution of any disputes and litigation – in these cases Asociația POT SĂ AJUT processes your personal data to protect itself against fraud, to protect the interests of its Partners, and to defend its rights and/or property in the context of potential or existing litigation. To fulfil this purpose, the Association may communicate personal data to third parties such as courts, authorities, or lawyers, or may disclose data in order to comply with a legal obligation to respond to requests from such third parties.
This purpose may be based on the following legal grounds:
- The Association's compliance with specific legal and regulatory obligations;
- Asociația POT SĂ AJUT's Legitimate Interest in addressing and managing the legal requirements applicable to the Association (whenever legal requirements do not directly mandate the processing of personal data, but achieving the objective involves processing your personal data), as well as in protecting itself against fraud and resolving any disputes or litigation, and in defending its rights and interests
h. Managing the relationship with authorities – in order to successfully carry out the Programs it supports, the Association may communicate personal data to public authorities. Also, given that certain Programs of Asociația POT SĂ AJUT are carried out in partnership with public authorities and are developed according to instructions received from them, the Association processes your data in order to carry out these Programs in accordance with the specified requirements.
This purpose may be based on the following legal grounds:
- The Association's compliance with specific legal obligations;
- Asociația POT SĂ AJUT's Legitimate Interest in implementing and successfully completing the Programs it supports and in addressing the legal requirements applicable to such Programs (whenever legal requirements do not directly mandate the processing of personal data, but achieving the objective involves processing your personal data).
4.2. Where your capacity is that of Candidate, Asociația POT SĂ AJUT processes your personal data for the following purposes
a. Managing recruitment activity – in this case the Association processes your personal data in order to recruit you, to verify your eligibility, and/or to place you in a job.
This purpose may be based on the following legal grounds:
- Entering into and performing a contract with you;
- The Association's compliance with specific legal obligations;
- Asociația POT SĂ AJUT's Legitimate Interest in verifying that the necessary criteria and standards are met.
b. Compliance with specific legal and regulatory requirements, contained in both national and European legislation.
This purpose may be based on the following legal grounds:
- The Association's compliance with specific legal and regulatory obligations;
- Asociația POT SĂ AJUT's Legitimate Interest in addressing and managing the legal requirements applicable to the Association (whenever legal requirements do not directly mandate the processing of personal data, but achieving the objective involves processing your personal data). Employees of Asociația POT SĂ AJUT will be informed about the processing of personal data separately from this policy, through internal documents.
5. What are your rights regarding the processing of personal data
Asociația POT SĂ AJUT guarantees and facilitates the exercise of the rights specific to the protection of personal data. To exercise these rights, please contact us using the methods and contact details mentioned in section 2. You have the following rights:
- To access your personal data – you have the right to obtain confirmation or denial of whether we process your data, and to obtain details such as the categories of data processed, the purpose, the recipients of the data, and the period of processing and storage.
- To request the modification and/or rectification of the data – if you consider that your data is incorrect or needs to be updated, you may request its rectification and/or modification.
- To request the restriction of processing – if you consider that we should not be processing your data, or if you consider the data to be incorrect and ask us to review it, in certain circumstances established by law you may obtain a restriction on processing.
- To object to processing – you have the right to object to data processed for direct marketing purposes or in our legitimate interest, providing a specific reason for the objection.
- To request the erasure of your personal data, or the transfer of the data you provided to another controller – in certain circumstances established by law you may obtain the erasure of your personal data, as long as the Association has no other legal grounds to process it. Transfer is also possible, in a structured, machine-readable format, only with respect to certain categories of data and only under the conditions established by law.
- To withdraw your consent whenever processing is based on your express consent.
- Not to be subject to an automated decision-making process that we might use in our activities, and to request human intervention regarding it.
- To lodge a complaint with the competent supervisory authority (in Romania, the competent authority is the National Supervisory Authority for Personal Data Processing, which can be contacted at anspdcp@dataprotection.ro). In this regard, we remain at your disposal to resolve any requests.
Please note that these rights may be limited, in certain circumstances, by law. Any such restrictions will be reviewed individually and will be communicated to you accordingly.
6. Processing of personal data by third parties
In order to implement and manage the Programs it supports, Asociația POT SĂ AJUT collaborates with various third parties. In this regard, where you have given your consent or there is a legitimate interest with respect to the processing of your personal data, Asociația POT SĂ AJUT may communicate this data to other persons.
Please note that Asociația POT SĂ AJUT will not communicate your personal data to any third party intending to use it for direct marketing purposes, unless you have given your consent to this effect.
However, in order to fulfil its purposes, Asociația POT SĂ AJUT may communicate your personal data to third parties only in the following situations:
- Partners – the organizations and individuals alongside whom the Association carries out its activity, such as associations, foundations, non-profit organizations, schools, trainers.
- Service providers – in order to provide and manage the Programs it supports, Asociația POT SĂ AJUT uses services provided by third parties, such as website administration services, delivery services, services for managing the Association's online presence, hosting services. In this regard, Asociația POT SĂ AJUT requires these third parties to comply with all applicable data protection laws and security requirements regarding personal data by entering into written agreements.
- External consultants or partners of the Association who provide assistance (e.g. external lawyers, collection agencies, product suppliers)
- Public and regulatory authorities – Asociația POT SĂ AJUT may communicate your personal data where required to do so by law, or where it believes, in good faith, that such disclosure is reasonably necessary for the proper conduct of legal proceedings, investigations, or to respond to any complaints.
